In consideration for my (or, if Participant is under age 18, my
child or ward) being allowed to participate in the National Yo-Yo
League Contest (“the Contest”), I, the undersigned,
hereby release and agree to indemnify and hold harmless the National
YoYo Museum (“the Museum”), the National Yo-Yo League
(“the League”), its directors, officers, employees,
and agents, and all persons sponsoring the Contest, and each of
them (collectively, “the Sponsors”) of and from any
and all claims, demands, actions, causes of action, liability,
loss, injuries, damages, costs, and expenses (collectively, “claims”),
howsoever caused, that I (or, if Participant is under age 18, my
child or ward) may suffer as a result of my (or, his or her) participating
in the Contest. In so agreeing, I acknowledge that the sport of
yo-yoing and participating in a yo-yo contest, by their nature,
involve the risk of being struck and injured by a yo-yo, whether
played by me or another contestant, and that injuries may include,
without limitation, cuts, bruises, broken bones, loss of consciousness,
and head injuries. With such knowledge, I fully assume all risk
of injury to me (or, to my child or ward) or damage to my (or,
to his or her) property by reason my (or, his or her) participation
in the Contest.
In further consideration for my (or, if Participant is under age
18, my child or ward) being allowed to participate in the Contest,
I hereby agree that the League and its assignees and licensees
may use and publish my (or, his or her) name, likeness, or image
in any medium or media or commercial reproduction for the purpose
of promoting and marketing the Contest, the Museum, the League,
or the sport of yo-yoing. I waive any right I may have to inspect
or approve any such use or publication of my (or, his or her) name
or likeness and release and indemnify and hold the League and its
assignees and licensees free and harmless of and from any and all
claims, however caused, arising out of or in any way connected
with their use of my (or, his or her) name, likeness or image for
such purposes. This agreement is without limitation as to duration
or frequency.
